Dear Mr Reid,

Thank you for your letter dated 10 January 2007

Thank you for your apology. However being “unaware of the box junction regulations” is not a defence or mitigation that I can accept, anymore than a motorist would expect to have a parking ticket dismissed if he or she was unaware of yellow lines.

Therefore, apology, not accepted. My readers would like the driver to make a donation  to a charity of my choice, Mencap. You are of course able to identify the driver. but, I suggest that NCP also contribute a substantial donation. I suggest £500, since you can easily afford that.

I turn now to your account of what happened during the issue of the parking ticket WM25857066. I think you have mixed up what was said and by whom. I was the one that was asking the questions, and it was the parking attendant who was refusing to answer. I asked him three times, why I should move, and he refused to answer, three times

I don't understand why, “He has denied saying anything”, because that is precisely what he should have done.

I was not obstructing the footpath.

We thank you for your email of 3 January 2007.

We expect our drivers to conform to the Highway Code at all times and would like to apologise to you for the fact that one of our drivers seemed to be unaware of the box junction regulations. All the drivers of our clamping vans who were on duty on 26 December 2006 have been spoken to and reminded of the high standard of driving we expect from them.

As far as penalty charge notice WM25857066 is concerned we would advise that the 1991 Road Traffic Act stipulates that all challenges against the issue of a penalty charge notice must in the first instance be made to the local authority. As you have already written to Westminster City Council they will investigate your challenge to the validity of the notice and reply to you direct.

Parking attendant WS4599 has been spoken to by his line manager and has said that he asked you to move your vehicle as he considered that you were blocking the path of pedestrians using Orchard Street. As you did not reply to him he felt he had no option other than to issue you with a penalty charge notice. He has denied saying anything to you after his initial request that you moved your vehicle

We can only apologise if the attendant was in any way rude or unhelpful as we do not condone such behaviour by our attendants. A copy of your letter has been placed on his personnel file.
